Byrne Waste Tracking — Terms of Service

1. Who we are

This service is provided by Wilf Byrne, trading as Byrne Digital Solutions (a sole trader), of 1 Kings Avenue, Newcastle-under-Lyme, ST5 8DA.

Contact: wilf@byrnedigitalsolutions.co.uk · 07935 173034

We are an independent supplier. We are not affiliated with, endorsed by, or acting on behalf of DEFRA, the Environment Agency, SEPA, NRW or DAERA.

2. What the service does

Byrne Waste Tracking helps you record waste received at your permitted site and produce a completed copy of DEFRA's Receipt of Waste spreadsheet template.

What it does:

What it does not do:

3. Your account

You must give accurate site details, including your permit number. You are responsible for keeping your login secure and for anything done under your account. Tell us promptly if you think it has been compromised.

4. Fees and cancellation

5. Your compliance remains yours — please read this

You are the operator. Legal responsibility for reporting your waste receipts to DEFRA rests with you and cannot be transferred to us. DEFRA's own guidance is explicit that the permit holder remains responsible for ensuring data is submitted.

Specifically, you remain responsible for:

We provide a tool. We do not provide compliance.

What Defra require us to tell you

Defra's terms for software providers (updated 9 October 2026) require us to tell you the following. Each of them is true, and each is part of these terms. "The Regulations" means The Digital Waste Tracking (England) Regulations 2026 (SI 2026/729), or for a site in Wales or Scotland the equivalent Welsh or Scottish regulations and their equivalent provisions.

6. Availability

We aim to keep the service available but do not guarantee uninterrupted access. We may carry out maintenance, and will give notice where reasonably practicable.

When Defra's own service is down, the app keeps your loads, says on screen that Defra's service is down, and sends each load once Defra answer again. It also keeps a dated record of each outage, with the loads that were waiting, for you to print or download. Regulation 6 of the Regulations still asks things of you as the operator: telling the regulator about the outage (unless Defra have already said the service is unavailable), keeping a written record of each load, and getting them entered within 7 days of the day after the outage ends. The outage record in the app is there to help you do that; it does not do it for you.

You should keep your own records. You can download a spreadsheet of every load you have recorded at any time, and DEFRA's own spreadsheet of any loads not yet sent. We recommend you keep a copy regularly.

7. Your data

8. Limitation of liability

8.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.

8.2 Subject to 8.1, we are not liable for: regulatory fines, penalties or enforcement action taken against you; loss of profit, revenue, business or goodwill; or any indirect or consequential loss.

8.3 Subject to 8.1, our total liability to you in any twelve-month period will not exceed the fees you paid us in that period.

8.4 If the service is unavailable or defective such that you cannot produce a return, your remedy is a refund of fees for the affected period.

8.5 These limits are reasonable given the fee charged and the fact that you retain legal responsibility for your own compliance under clause 5.

9. Ending the agreement

You may end this agreement at any time, as set out in clause 4. We may end it on 30 days' notice by email, or suspend or end it immediately if fees go unpaid or the service is used unlawfully.

10. Changes

We may update these terms and will give at least 30 days' notice by email of anything material. Continuing to use the service after that means you accept the change.

11. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any clause is unenforceable, the rest stands.
