Byrne Waste Tracking — Terms of Service
1. Who we are
This service is provided by Wilf Byrne, trading as Byrne Digital Solutions (a sole trader), of 1 Kings Avenue, Newcastle-under-Lyme, ST5 8DA.
Contact: wilf@byrnedigitalsolutions.co.uk · 07935 173034
We are an independent supplier. We are not affiliated with, endorsed by, or acting on behalf of DEFRA, the Environment Agency, SEPA, NRW or DAERA.
2. What the service does
Byrne Waste Tracking helps you record waste received at your permitted site and produce a completed copy of DEFRA's Receipt of Waste spreadsheet template.
What it does:
- Records waste movements and waste items against your site and permit
- Tracks the two-working-day reporting window on each load
- Fills in DEFRA's own spreadsheet template with your data, for you to upload, and — once you link your DEFRA account — can send your loads to DEFRA for you
What it does not do:
- Until you link your DEFRA account, it does not submit anything to DEFRA — you upload the spreadsheet yourself. Once linked, it sends on your instruction; you remain responsible for what is sent and for checking it arrived.
- It does not decide whether a movement is reportable, or whether your site is in scope.
- It is not legal, regulatory or compliance advice.
3. Your account
You must give accurate site details, including your permit number. You are responsible for keeping your login secure and for anything done under your account. Tell us promptly if you think it has been compromised.
4. Fees and cancellation
- £89 per month per site. The same price for every site, with unlimited loads and unlimited users. There are no multi-site bundles and no annual plans. Prices exclude VAT (we are not currently VAT registered).
- Setting it up yourself is free. Create an account on the website, add your site and start: there is no setup fee.
- Introduced by a consultant. Where a consultant has agreed a setup fee for the sites they introduce, you are told the amount before you pay anything.
- Start free. If you subscribe before 1 November 2026, your first payment is on 1 November 2026, when the £89 monthly fee starts. From 1 November 2026, every new subscription gets 14 days free from the day you subscribe, then £89 a month per site.
- Scotland and Northern Ireland. A site in Scotland or Northern Ireland that subscribes before 1 January 2027 is charged nothing until 1 January 2027, the day the duty starts there, then £89 a month per site.
- Anyone already asked for a £70 setup fee before 14 October 2026 pays it as agreed.
- Billed monthly in advance. No minimum term.
- You may cancel at any time, effective at the end of your current paid month. Cancelling is no harder than signing up — email wilf@byrnedigitalsolutions.co.uk.
- We will give at least 30 days' notice by email before any price change. If you don't accept it, you may cancel before it takes effect.
- Fees already paid are not refunded on cancellation, except where required by law or where clause 8.4 applies.
5. Your compliance remains yours — please read this
You are the operator. Legal responsibility for reporting your waste receipts to DEFRA rests with you and cannot be transferred to us. DEFRA's own guidance is explicit that the permit holder remains responsible for ensuring data is submitted.
Specifically, you remain responsible for:
- deciding whether your site is in scope and which movements are reportable
- the accuracy of everything entered into the service
- checking each generated spreadsheet before you upload it
- getting each load to DEFRA within the statutory deadline — by uploading the spreadsheet, or by checking that automatic sending has worked
- registering with DEFRA and paying their annual charge
We provide a tool. We do not provide compliance.
What Defra require us to tell you
Defra's terms for software providers (updated 9 October 2026) require us to tell you the following. Each of them is true, and each is part of these terms. "The Regulations" means The Digital Waste Tracking (England) Regulations 2026 (SI 2026/729), or for a site in Wales or Scotland the equivalent Welsh or Scottish regulations and their equivalent provisions.
- Do your own checks. You are responsible for your own due diligence in choosing software that captures and sends the information Schedule 1 to the Regulations requires, and for satisfying yourself that this software meets those requirements.
- Our test results are published. You can check our self-certification test results (Defra's published test scenarios, with the date we last ran them) on our test results and known limits page. We run the scenarios again after any change to the software that could affect how it captures, checks or sends your information, and keep a dated record of every run.
- Defra's access is not a seal of approval. Defra issuing us production credentials is not confirmation by Defra that this software is compliant, and you cannot rely on it as such. Defra do not test, mark, certify or endorse this software, and our place on GOV.UK's list of software providers only means the software can connect to Defra's service.
- The legal duty stays with you. Responsibility for complying with regulation 4 of the Regulations, and liability for any failure to do so (including under regulations 16 and 19 and Schedule 2), rests with you as the operator receiving the waste, whatever any limitation, gap or defect in this software.
- Our known limits. Everything we know this software does not do, or has not been tested for, is listed in plain words under "Known limits" on the same page, so you can decide what it means for your own compliance. We update that list whenever it changes.
6. Availability
We aim to keep the service available but do not guarantee uninterrupted access. We may carry out maintenance, and will give notice where reasonably practicable.
When Defra's own service is down, the app keeps your loads, says on screen that Defra's service is down, and sends each load once Defra answer again. It also keeps a dated record of each outage, with the loads that were waiting, for you to print or download. Regulation 6 of the Regulations still asks things of you as the operator: telling the regulator about the outage (unless Defra have already said the service is unavailable), keeping a written record of each load, and getting them entered within 7 days of the day after the outage ends. The outage record in the app is there to help you do that; it does not do it for you.
You should keep your own records. You can download a spreadsheet of every load you have recorded at any time, and DEFRA's own spreadsheet of any loads not yet sent. We recommend you keep a copy regularly.
7. Your data
- Your waste movement records remain yours. We claim no ownership of them.
- We process them only to provide the service — see the Data Processing Agreement, which forms part of these terms. Email wilf@byrnedigitalsolutions.co.uk and we will send you a copy.
- Data is held in the United Kingdom.
- On termination you may export your data. It stays readable for 30 days after your account closes, and we delete it within 90 days of closing, unless you ask us to delete it sooner.
8. Limitation of liability
8.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
8.2 Subject to 8.1, we are not liable for: regulatory fines, penalties or enforcement action taken against you; loss of profit, revenue, business or goodwill; or any indirect or consequential loss.
8.3 Subject to 8.1, our total liability to you in any twelve-month period will not exceed the fees you paid us in that period.
8.4 If the service is unavailable or defective such that you cannot produce a return, your remedy is a refund of fees for the affected period.
8.5 These limits are reasonable given the fee charged and the fact that you retain legal responsibility for your own compliance under clause 5.
9. Ending the agreement
You may end this agreement at any time, as set out in clause 4. We may end it on 30 days' notice by email, or suspend or end it immediately if fees go unpaid or the service is used unlawfully.
10. Changes
We may update these terms and will give at least 30 days' notice by email of anything material. Continuing to use the service after that means you accept the change.
11. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any clause is unenforceable, the rest stands.
